*It is important that the Outfitter is contacted by the hunter before their scheduled hunt. Helping Heroes Hunt is not responsible for any changes/arrangements between the hunter and the Outfitter. There is no deposit/hunt payment refund on this hunt. If something happens where you can’t make your hunt dates, you will be required to work with the outfitter on rescheduling. NON-WARRANTY AND DISCLAIMER OF LIABILITY Goods – Any goods which are the subject of this sales contract have been acquired or obtained by Helping Heroes Hunt from third parties. Buyer acknowledges that the goods have not been inspected by Helping Heroes Hunt. and that the Buyer is advised, in the case of firearms, knives, bows, or other weapons, to secure a competent inspection and test of the goods at the time of acceptance by Buyer. The goods covered by this invoice are sold as is with all faults and defects and without any expressed or implied warranty on the part of Helping Heroes Hun., Helping Heroes Hunt makes no warranty of any kind regarding the goods, which are provided on an “as is” basis. Helping Heroes Hunt expressly disclaims all warranties of any kind, expressed or implied, including but not limited to any warranties of title, implied warranties of merchantability, or fitness for a particular purpose. No oral or written information provided by Helping Heroes Hunt or its affiliates, officers, directors, employees, agents, providers, merchants, sponsors, licensors or the like shall create a warranty; nor shall you rely on any such information or advice. Any warranties provided by the manufacturer with respect to the goods delivered to buyer are solely the warranties of the manufacturer or vendor and not Helping Heroes Hunt. Helping Heroes Hunt shall not be responsible or liable for the design, manufacture, or use of the goods. Services – All services covered by this invoice have been acquired or obtained from and will be furnished by third party vendors. Helping Heroes Hunt provides services that connect consumers to vendors and Helping Heroes Hunt has no ownership or control over the vendor or the products or services offered by the vendor. No services which are the subject of this sales contract will be provided or performed by Helping Heroes Hunt. Any and all third-party vendors who furnish the services which are the subject of this contract are neither agents nor employees of Helping Heroes Hunt and Helping Heroes Hunt shall not be liable for the acts, errors, omissions, representations, breaches, or negligence of any such third parties or for any personal injuries, death, property damage, or other damages or expense resulting there from. Helping Heroes Hunt will make no refund in the event of any delay or cancellation due to overbooking, strike, force majeure, pandemic, or any other causes beyond Helping Heroes Hunt’s direct control, and Helping Heroes Hunt has no responsibility for any additional expense, omissions, delays, re-routing, or cancellations due to acts of any government or authority, or any political unrest or caused by political instability that occurs outside the confines of the United States. Helping Heroes Hunt disclaims all warranties, express and implied for any services which are the subject of this sales contract. In no event shall Helping Heroes Hunt be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, the services which are the subject of this sales contract whether based on contract, tort, strict liability or otherwise. Buyer acknowledges and agrees that Helping Heroes Hunt shall be entitled to all of its costs and actual attorney’s fees if: (1) It takes any legal action or incurs attorney’s fees or costs to collect any and all amounts due for the goods or services which are the subject of the sales contract; or (2) Helping Heroes Hunt incurs attorney’s fees and costs to defend itself against any and all claims made against it for the liability described above. Buyer agrees that venue for any action shall be Wood County, Texas and the laws of the State of Texas shall apply. I HAVE READ AND FULLY UNDERSTAND ALL OF THE TERMS AND CONDITIONS OF THIS SALES CONTRACT AND AGREE TO HOLD HELPING HEROES HUNT HARMLESS AND INDEMNIFY IT AGAINST ANY AND ALL CLAIMS AND DEMANDS WHICH ARISE FROM OR ARE CONNECTED WITH THE GOODS AND/OR SERVICES WHICH ARETHE SUBJECT OF THIS SALES CONTRACT.
